ITR Filing Rules, Deadlines & Fees at a Glance

- ITR filing due date (non-audit individuals)
- ITR-1 and ITR-2 for AY 2026-27 (FY 2025-26) are due by 31 July 2026 for taxpayers who don’t require a tax audit. CBDT can extend this date by notification, so check the e-filing portal if you’re close to the deadline.
- Late filing penalty (Section 234F)
- ₹5,000 if total income exceeds ₹5 lakh, ₹1,000 if total income is ₹5 lakh or below. A belated return can still be filed up to 31 December of the assessment year, along with interest under Section 234A on any unpaid tax.
- Old vs new tax regime
- The new regime (Section 115BAC) is the default since FY 2023-24, with a ₹4 lakh basic exemption limit and a ₹75,000 standard deduction for salaried taxpayers (FY 2025-26). The old regime keeps its ₹2.5 lakh exemption limit plus deductions like 80C/80D/HRA, but must be actively chosen while filing.
- E-verification window
- A filed return must be e-verified (or its ITR-V submitted) within 30 days of filing. Miss the window and the return is treated as not filed, requiring a fresh submission.
- Documents typically needed
- Form 16 (for salaried income), bank statements for the year, Form 26AS/AIS, investment proofs for deductions claimed, and PAN and Aadhaar.
